1. About These Terms

Welcome to HYL.

These Terms & Conditions ("Terms") apply when you access or use the HYL website, purchase products from us, create an account, submit content or otherwise use our online services.

Throughout these Terms, "HYL", "we", "us" and "our" refer to HYL.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

By using our website or placing an order with HYL, you agree to these Terms together with our Privacy Policy, Returns & Refunds Policy and any other policies referenced on our website.

Nothing in these Terms affects your statutory rights as a consumer.

2. Using Our Website

You may use our website only for lawful purposes.

You must not:

• Use the website for fraudulent or unlawful purposes

• Attempt to gain unauthorised access to our website, systems or customer accounts

• Introduce viruses, malicious code or other harmful technology

• Interfere with the operation or security of our website

When placing an order or providing information to us, you agree that the information you provide is accurate, complete and current.

We make reasonable efforts to ensure product descriptions, photographs, sizing information, colours and other information displayed on our website are accurate.

However, colours and appearance may vary slightly depending on your screen, device and display settings.

Because some HYL products may be produced or fulfilled to order, minor variations may occur where reasonable and where they do not materially alter the product.

Nothing in this section affects your rights where goods are faulty, damaged, misdescribed or otherwise do not conform to your legal rights.

We may change or discontinue products and may limit availability or quantities where reasonably necessary.

5. Product Availability

All products are subject to availability.

Adding an item to your basket does not reserve that product.

If we are unable to fulfil an order after it has been placed, we will contact you and, where appropriate, issue a refund for the affected item.

6. Orders

When you place an order with HYL, you are making an offer to purchase the products contained in that order.

You will normally receive an email acknowledging that we have received your order. An acknowledgement does not necessarily mean that your order has been accepted.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

• A product is unavailable

• Payment cannot be authorised

• We identify an obvious pricing or product-information error

• We reasonably suspect fraud or misuse

• We are unable to deliver to the address provided

If we cancel an order after payment has been taken, we will refund the appropriate amount.

Please check your order carefully before submitting it.

If you need to change or cancel an order, contact us as soon as possible. Because some products may enter production or fulfilment shortly after an order is placed, we cannot guarantee that changes can be made once processing has begun.

Your statutory cancellation rights are not affected.

7. Prices & Payment

Prices displayed on our website are shown in the currency indicated at checkout.

Where applicable, prices will include taxes required to be included in the advertised consumer price.

Delivery charges and any other applicable charges will be clearly shown before you complete your purchase.

We may change prices at any time, but this will not normally affect an order that has already been accepted.

Occasionally, a pricing error may occur. If we discover an obvious error affecting your order, we may contact you to give you the option of purchasing at the correct price or cancelling the affected item.

Payments are processed securely through Shopify and/or the payment providers made available at checkout.

You confirm that you are authorised to use the payment method provided.

8. Discount Codes & Promotions

From time to time, HYL may offer discount codes, promotional pricing or other offers.

Unless otherwise stated:

• Promotional codes cannot be exchanged for cash

• Only one discount may be used per order where our checkout does not permit discounts to be combined

• Promotions may have specific eligibility requirements or expiry dates

• We may withdraw or amend a promotion before an order is placed

Any specific terms displayed with a promotion will apply in addition to these Terms.

9. Shipping & Delivery

Orders may require processing or production before dispatch.

Estimated processing and delivery times may be displayed on our website or at checkout. Unless expressly stated otherwise, these are estimates rather than guaranteed delivery dates.

Delivery may occasionally be affected by circumstances outside our reasonable control.

We will provide tracking information where available.

Your order will be delivered to the delivery address supplied when you place your order. Please ensure that your delivery information is accurate before completing your purchase.

Nothing in these Terms is intended to transfer risk to you earlier than permitted under applicable consumer law.

10. Returns, Refunds & Cancellation Rights

Returns and refunds are handled in accordance with our Returns & Refunds Policy and applicable UK consumer law.

HYL currently offers eligible customers a 30-day returns period, subject to the conditions set out in our Returns & Refunds Policy.

UK consumers purchasing online may also have statutory cancellation rights, including a right to cancel many online purchases within 14 days of receiving the goods, subject to applicable exceptions.

Our voluntary returns policy does not limit your statutory rights.

11. Faulty, Damaged or Incorrect Products

You have legal rights in relation to goods that are faulty, damaged, misdescribed or otherwise do not conform to the contract.

Where appropriate, we may request photographs or other reasonable information to help us assess the issue.

Nothing in these Terms excludes or limits rights or remedies available to you under applicable consumer law.

12. Intellectual Property

Unless otherwise stated, the content available through the HYL website—including the HYL name, logos, branding, product designs, graphics, photographs, videos, text and website content—is owned by or licensed to HYL and is protected by applicable intellectual-property laws.

You may access our website for your personal, non-commercial use.

You must not reproduce, copy, distribute, modify, commercially exploit or use HYL intellectual property without our prior permission, except where permitted by law.

Third-party trademarks and intellectual property remain the property of their respective owners.

You may have the opportunity to submit reviews, photographs, videos, comments or other content.

You must only submit content that you have the right to provide.

Your content must not:

• Be false or deliberately misleading

• Be unlawful, defamatory, abusive or discriminatory

• Contain malicious software

• Impersonate another person

By submitting content for publication, you grant HYL a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with operating, marketing and promoting HYL and its products, subject to applicable law and our Privacy Policy.

We may moderate or remove content where we reasonably believe it violates these Terms or applicable law.

14. Third-Party Services

Our website may use or provide access to services operated by third parties, including payment providers, review services, social-media platforms, fulfilment providers and other ecommerce tools.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for third-party websites that we do not own or control.

15. Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce technology that enables HYL to operate this website. However, purchases made from our store are made from HYL, not Shopify.

Shopify is not the seller of HYL products.

Certain personal information may be processed by Shopify in connection with your use of our store. Please see our Privacy Policy for further information.

16. Privacy

We process personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what information we collect, how we use it, who it may be shared with and the rights available to you.

17. Website Availability

We aim to keep our website available and operating correctly but cannot guarantee that it will always be uninterrupted, secure or free from errors.

We may temporarily suspend or restrict access where reasonably necessary for maintenance, security, technical reasons or circumstances outside our control.

18. Our Responsibility to You

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

Where permitted by law, HYL will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by someone purchasing primarily for commercial purposes.

If you are purchasing as a consumer, these Terms do not affect protections provided to you by applicable UK consumer law.

19. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include disruption to transport or delivery networks, natural disasters, severe weather, industrial action, telecommunications failures or other events that we could not reasonably prevent.

Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with you where appropriate.

Your statutory rights remain unaffected.

Changes will not normally alter the terms applying to an order that has already been accepted unless required by law.

Nothing in this section excludes rights that cannot legally be excluded.
